These Terms of Use ("Terms") are an agreement between you and Ketchum Applied Technologies of Sun Valley, Idaho ("we," "us," or "our") governing your use of the Cutwise Fraction Calc mobile application ("the App"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices that you own or control, solely for your personal or internal business use, in accordance with these Terms and Apple's App Store terms. You may not copy, modify, distribute, sell, sublicense, reverse engineer, or create derivative works from the App, except where such restrictions are prohibited by applicable law. All rights not expressly granted are reserved by Ketchum Applied Technologies.
THE APP'S LEVEL, CALCULATORS, AND UNIT CONVERTERS PRODUCE ESTIMATES ONLY.
The App is a convenience tool for planning and rough calculation. It is not a precision instrument, and its outputs depend on factors we cannot control, including your device's sensors, calibration, screen size, rounding behavior, and the accuracy of the values you enter.
YOU MUST INDEPENDENTLY VERIFY ALL RESULTS WITH APPROPRIATE PHYSICAL TOOLS — such as a tape measure, spirit level, square, or other calibrated instruments — before cutting material, fastening, building, or making any decision based on the App's output.
THE APP IS NOT INTENDED FOR, AND MUST NOT BE RELIED UPON FOR, STRUCTURAL DECISIONS, SAFETY-CRITICAL APPLICATIONS, OR BUILDING-CODE COMPLIANCE. It is not a substitute for the judgment of a licensed contractor, engineer, architect, or building inspector, and it does not verify compliance with any building code, regulation, or standard.
YOU ASSUME ALL RISK arising from your use of the App's measurements, calculations, and conversions, including but not limited to wasted or miscut materials, project delays, construction defects, property damage, and personal injury. Measure twice, cut once — and don't rely on the App as your only measurement.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT ITS RESULTS WILL BE ACCURATE OR SUITABLE FOR YOUR PURPOSES. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KETCHUM APPLIED TECHNOLOGIES AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF MATERIALS, PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP — INCLUDING DAMAGES RESULTING FROM RELIANCE ON ANY MEASUREMENT, CALCULATION, OR CONVERSION — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR FIFTY U.S. DOLLARS ($50). Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
The App may offer a one-time in-app purchase (for example, to remove advertising or unlock features). All purchases are processed by Apple through the App Store; we never receive or handle your payment information. All purchases are non-refundable by us — we have no ability to issue refunds directly. Refund requests must be made through Apple in accordance with Apple's App Store refund policies, at Apple's discretion. Purchases are tied to your Apple ID under Apple's terms; restoring purchases is handled through Apple's standard restore mechanism.
All projects, saved measurements, and preferences are stored locally on your device only. Deleting the App permanently deletes this data, and we cannot recover it. You are responsible for recording any information you wish to keep.
We may update, modify, or discontinue the App or any feature at any time without notice. We may also revise these Terms; the updated version will be posted with a new effective date, and your continued use of the App constitutes acceptance.
These Terms are governed by the laws of the State of Idaho, USA, without regard to its conflict-of-law principles. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Idaho, and you consent to their jurisdiction, except where applicable law provides otherwise.
